Philip Murgor, SC on his submissions on whether the technology deployed by the Independent Electoral and Boundaries Commission (IEBC) for the conduct of August 9,2022,met the standards of integrity, verifiability,  security, and transparency to guarantee accurate and verifiable results.

SC Murgor said the three Venezuelans who were arrested at the JKIA by the DCI had direct access to the IEBC servers.  The 3 accessed the virtual walls of the IEBC and tampered with results.

The DCI audit report indicated that the three Venezuelans arrested at Jomo Kenyatta International Airport (JKIA) had substantial IEBC data and election system.

SC Murgor further said PA of IEBC chairperson Wafula Chebukati had direct access to the servers yet he was not authorised employee of the commission.

“There is overwhelming evidence of back tallying of results. There was a process of back changing results of Forms 34A, 34B to correspond to form 34C” SC Murgor explained.

Sc Philip Murgor alluded that the technology deployed in the 2022 general elections failed and the standards of a secure and transparent voting system and therefore invalid results.

Philip Murgor also distinguished the difference between hacking and unauthorised access. Szc Murgor said hacking is where a person outside the system accesses through the back door and enters the system. Illegal access is where passwords are granted to unknown users.

IEBC personal who were not gazetted, or with restricted access did access the IEBC system.  For instance IEBC chairperson PA Dickson Kwanisu had access and privileges to the system and verified 1743 forms 34A.

Murgor adds that the technology was so inherently corrupted and manipulated and tainted that the results declared by Chebukati are not objectively a true representation of the will of the Kenyan people.

The elections was controlled from everywhere except the IEBC. Some individuals were given super admin access to the IEBC servers hence manipulated the results.

Finally Murgor said he has plenty affidavit evidence on record to prove his submissions on how the IEBC systems were compromised
