Rigoma Ward MCA Nyambega Gisesa has written demand letters to Governor Arati and Ichuni MCA for defamation, regarding the Keroka Boundary dispute.
Through his Lawyer Calvin Oira, Nyambega said Governor Arati, on April 5th, 2024, in a meeting with Kisii County Boda Boda riders at Gusii Stadium, defamed him through words he knew were false, malicious, and abusive.
“I know there is a problem at Keroka. Keroka, I want to address it that the judge in court gave us a Ruling. Myself and my counterpart, we met, we discussed and we agreed we were to form a committee of five people from Kisii and Nyamira to look into the issues of Keroka. But it’s unfortunate, there is an MCA from Nyamira who is inciting Wananchi in Keroka to fight. We will not accept… … I’m told there’s a DC, a woman from Nyamira, who is a girlfriend of that MCA. She is the one who is moving around putting police vehicles… That lady came for administrative work. If she came to find a man who is an MCA, let them go and stay at their home. She cannot use that proximity to cause chaos at Keroka. They go and sit down with that gentleman and conspire, ‘You use the OCPD’s vehicle to announce and cause anxiety’…”
His lawyer, through the letter, says that Governor Arati implied that MCA Gisesa is adulterous and unfaithful to his wife, a thug, corrupt, and exploitative.
He further says that Governor Arati, on March 16th, 2024, during the Mkisii Festive 2, called MCA Nyambega an inciter of violence
“”Omomura oyo Nyambega Gisesa nere otaete esegi ebe ari Keroka. Nere omoMCA Rigoma Ward” (this young man Nyambega Gisesa wants violence in Keroka. He’s the MCA Rigoma Ward)”
The lawyer adds that Nyambega has never had any relationship with the DC or DCC and neither used any National Government administration official to frustrate traders or anyone in Keroka town.
Gisesa, through his lawyers, wants the Governor to Retract his allegations by publishing an unqualified apology in two newspapers of nationwide circulation, published with the same prominence and vigour, and in a similar manner as the offending speech within three (3) days of the date hereof
He also wants Governor Arati to unequivocally acknowledge defaming him, both outrightly and by innuendo, so we can discuss the quantum to purge the defamatory statement.
And lastly Refrain and desist from publishing and/or causing to be published any further defamatory content, either explicitly or by innuendo, against the MCA
Gisesa has also issued a demand letter to Ichuni Ward MCA Wycliffe Siocha Embande.Gisesa, through his lawyers, says that on April 12th, 2024, Siocha published defamatory content against him on his Facebook page, which he knew was false and malicious
“I was a hustler selling second-hand clothes in Nakuru before the people of Ichuni uplifted me to what I’m today by overwhelmingly voting for me in the 9th of August 2022. No person can understand the pain and agony these hustlers are going through HAVING THEIR SOURCE OF LIVING TORCHED DOWN BY GOONS FROM NYAMIRA SENT BY ONE GISESA simply because the orders that were issued by the Court of Appeal weren’t favorable to them.”
He further says that MCA Siocha attached pictures of the remains of fruits, implying that Gisesa caused the burning of the fruits.
He further said on April 13th, 2024, he published another defamatory content
“KEROKA! I promised yesterday to compensate all those who incurred losses due to the fire incident CAUSED BY GISESA AND HIS GOONS led by Hesborn, Onyari, Joseph, and Babu… I am asking the DCIO Nyamira County why they haven’t arrested Gisesa and his team to this end…… The member of Parliament is missing. The woman rep is missing, and the senator is equally missing. All of them work for the national government. It is the national government fighting behind bars in Keroka using Gisesa and not county governments. I want to inform the public that when the affected traders at Keroka went to record their statements yesterday, they were all chased away by police officers blatantly telling them that they were under instructions from above that they don’t allow them to record statements……”
Gisesa wants Ichuni Ward MCA to retract his allegations by publicizing an unqualified apology on his Facebook page published with the same prominence and vigour, and similarly, as the offending post within three (3) days of the date hereof and Delete the offending post complained of within three (3) days of the date hereof
